Terms and Conditions for The Drive Application

By accessing, browsing, connecting, using, or creating an account on The Drive application on iPhone, iPad, Android, or any mobile device application, you acknowledge that you have read and understood these terms and conditions and our privacy policy, and agree to comply with and abide by all applicable laws and regulations regarding your use of The Drive application. Furthermore, you acknowledge that these terms constitute a binding and enforceable legal contract between you and us.

Please read these terms before requesting any product through our application.

By browsing, accessing, connecting, using, or creating an account on The Drive application, you declare your agreement to abide by these terms.

Therefore, you are responsible for making all necessary arrangements to access The Drive application and ensuring that all persons who access The Drive application through your internet connection are fully aware of these terms and comply with them. By displaying, using, accessing, browsing, or submitting any content or material on the platform, you agree to these terms as a binding legal agreement without any reservation or condition. Thus, the term "you" or "your" includes any person or entity who displays, uses, accesses, browses, or submits any content or material on The Drive application.

If you do not agree to these terms, you are not permitted to use this platform. The Drive application reserves the right to modify these terms at any time without prior notice. On the other hand, you agree that each visit you make to The Drive application should be subject to the terms as stated, and your continued use of The Drive application now or after any modifications to these terms confirms your reading, acceptance, and agreement to comply with these modifications.

The Service

The Drive application allows its users who agree to its terms to request products from partner restaurants, sellers, and other entities that may be operated and managed by third parties or companies affiliated with The Drive application.

The purpose of The Drive application is to provide a simple and convenient service to users by connecting them with merchants for delivery of orders (referred to as "our service") and enabling them to order a variety of goods, including ready-made meals, drinks, non-prepared foods, and various non-food items (referred to as "goods"). Interactive options allow users to place orders with a single click. When you request an order from a merchant, The Drive application acts as an intermediary on behalf of that merchant to fulfill your order through The Drive application and manage your experience by managing the order. We have created The Drive application to serve as a marketplace for its users.

The Drive application does not sell or intervene in any way in the production of any goods or services produced by merchants. However, users must understand and acknowledge that The Drive application does not independently verify any credentials, endorsements, or merchant products or components or the quality of any products, or that the merchant complies with applicable laws. Users should feel comfortable with the information provided by merchants on The Drive application or directly from merchants at the request of users regarding the quality and reliability of merchants, as well as their compliance with applicable laws.

In addition, The Drive application does not guarantee in any way the quality of any goods or the compliance of any goods with applicable laws, nor does it guarantee that the list of goods displayed on The Drive application matches what is actually provided to users. Furthermore, the merchant may acknowledge that the preparation of goods and services complies with special standards, such as (but not limited to) "organic" or "vegetarian" standards or standards regarding allergens such as nuts, gluten, or lactose-free foods. However, The Drive application is not obligated to provide information on ingredients or allergens on the application. Additionally, The Drive application does not guarantee that goods sold by merchants are free of allergens unless required by applicable laws to the contrary. If you have allergies or allergic reactions, or dietary restrictions and requirements, please contact the merchant before ordering any items on The Drive application to independently verify or confirm these statements.

Therefore, The Drive application and merchants, as appropriate, reasonably seek to comply with your specific instructions for an order. However, in some cases, where it is not possible or available or commercially reasonable to do so, The Drive application and/or merchants reserve the right to proceed with preparing the order according to standard operating procedures, but The Drive application and merchants are not responsible for replacing or refunding an order that does not comply with the specific instructions you requested.

The Drive application will not be legally responsible or liable for any goods or services provided by merchants that are unhealthy, causing harm, or unacceptable to users in any way.

Users

Users are solely responsible for verifying the accuracy of their orders, and The Drive application is not liable for any legal or other responsibility for any such incorrect orders. Rather, the merchant who agreed to the order is solely responsible for preparing and delivering all goods and services. Please note that the merchant will do everything in their power to meet the specified delivery time, but delivery times may be affected by factors beyond their control, and therefore delivery times cannot be guaranteed. We will notify you if we become aware of any unexpected delays.

How to log in to The Drive application

To use The Drive application, users create an account using their mobile phone number. Signing in is passwordless: you confirm your identity with a one-time verification code (OTP) sent to you by SMS or WhatsApp, or by signing in with your Google or Apple account. There is no username or password to remember. Your account is personal to you and must not be shared with others, and it is your responsibility to keep the phone number, email address, and linked Google or Apple account used for sign-in secure. The Drive application is not responsible for any problems arising from a failure to keep your sign-in details or device secure. The Drive application may notify you of promotional offers through in-app and push notifications, or email. To provide our service, certain account information may be shared with companies that help us deliver it — for example, your name and phone number may be shared with the merchant handling your order to provide faster and more accurate delivery.

To access services that require an account, you must verify your identity using your phone number and verification code (or your linked Google or Apple account) — this is referred to as "signing in" to The Drive application. By using The Drive application, you guarantee that any personal data you provide is accurate, complete, and up to date, and you will immediately notify us of any changes by updating your profile or by contacting us. You agree not to impersonate any other person or entity or use a false or unauthorized name.

Furthermore, you are not allowed to use The Drive application for illegal or unauthorized purposes, including but not limited to:

1. Distributing any illegal, defamatory, abusive, dangerous, harmful, obscene, or unwanted materials in any other form, as transferring materials that constitute a criminal offense leads to civil liability or is in violation of any laws or regulations or codes of conduct.

2. Interfering with the use of The Drive application by any other persons.

3. Destroying, disabling, or impairing the operation of The Drive application or attempting to gain unauthorized access to this platform or its connected networks, by hacking or impersonation or other similar means.

4. We expect each device to have only one user account. We may allow the service in such cases, but we will not allow the use of promotional offers.

5. If you wish to delete your account, please contact us via The Drive application chat function to activate the deletion request.
